Plaintiffs cross motion for judgment on the pleadings is granted. The Court finds that the ALJ erred by failing to properly apply the treating physician rule, and failing to properly assess Plaintiffs credibility. The Court declines to find that the ALJ erred in failing to develop the rec ord or in relying on the vocational expert testimony. The Commissioners decision is vacated and this action is remanded for further administrative proceedings. The Clerk of Court is directed to close this case. Ordered by Judge Margo K.
