Filing 5 MEMORANDUM DECISION AND ORDER.The complaint is dismissed for lack of subject matter jurisdiction and indecipherability pursuant to Fed.R.Civ.P. 12(b)(6) and 12(h)(3). However, in light of plaintiffs pro se status and in an abundance of caution , plaintiff is directed to file an amended complaint within twenty (20) days from the date of this order that complies with Rule 8 of the Federal Rules of Civil Procedure. Although plaintiff has paid the filing fee to initiate this action, the Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. Ordered by Judge Brian M. Cogan on 3/18/2013. (Cogan, Brian) |
