Filing 36 ORDER granting 25 Motion for Judgment on the Pleadings and denying 31 Motion for Extension of Time to Serve Defendants. For the reasons set forth in the attached Memorandum and Order, defendants' Rule 4(m) motion to dismiss claims against the individual defendants for failure to serve process is granted and all claims against the individual defendants are dismissed with prejudice. Defendants' Rule 12(c) motion for judgment on the pleadings against the City and DOC is also grant ed. Plaintiff's claims against the DOC are dismissed with prejudice, as is plaintiff's claim against the City based on a theory of respondeat superior. Plaintiff's claim against the City pursuant to 42 U.S.C. § 1983 for "careless and reckless" hiring and retention is dismissed without prejudice. Plaintiff shall have until January 15, 2016 to file an amended complaint solely as to this claim. Plaintiff's motion for an extension of time to serve the individual defendants is denied as moot.
