Filing 18 ORDER: For the reasons contained in the attached memorandum and order, the claims in plaintiff's 8 Amended Complaint against defendants James L. Tomarken, Vincent DeMarco, Charles Ewald, and Vincent Geraci are dismissed. As per the court' s 6 order entered on 9/19/2013, this action may proceed against defendants Dennis Russo and Brett Ruffo. The case is hereby respectfully referred to Magistrate Judge Lois Bloom for pretrial supervision. A copy of this Order and the attached Memorandum has been mailed to the Plaintiff at his address of record. Ordered by Judge John Gleeson on 12/13/2013. The Clerk of the Court is directed to issue a summons against Dr. Dennis Russo and Dr. Brett Ruffo and the United States Marshals Service is directed to serve the complaint and this Order on the defendants without prepayment of fees. A courtesy copy of the same documents shall also be served on the Suffolk County Attorney. The complaint is dismissed against the remaining defendants - James L.
