Filing 43 CORRECTED MEMORANDUM DECISION AND ORDER granting 32 Motion for Summary Judgment. This action, seeking damages for false arrest, malicious prosecution, and related claims under 42 U.S.C. § 1983, should never have been brought. The undispute d facts show not only that there was probable cause for plaintiff's arrest, but that if the defendant police officers had not arrested plaintiff, they would have been derelict in their duty. Defendants' motion for summary judgment is therefore granted. The Clerk is directed to enter judgment, dismissing the complaint. Ordered by Judge Brian M. Cogan on 10/2/2014. (Barrett, C) |
