March 27, 2015 Opinion or Order Filing 28 MEMORANDUM AND ORDER ADOPTING REPORT AND RECOMMENDATIONS: For the reasons stated in the attached Memorandum and Order, the R&R is adopted in its entirety; plaintiff's motion for default judgment is GRANTED, plaintiff's motion to voluntaril y dismiss the John Doe defendant from the action is GRANTED, and it is hereby ORDERED that plaintiff be awarded a total of $142,196.32, consisting of: $55,192.50 in unpaid overtime wages; $57,713.91 in liquidated damages; $2,500 f or failure to provide statements required under the New York law; $11,433.50 in attorneys fees, $475.15 in costs; and $14,881.26 in prejudgment interest; and that defendants B S Supermarket, Inc. and Eddy L. Fernandez pay post-judgment interest. The Clerk of Court is directed to enter Judgment accordingly, transmit copies of this Order and the accompanying Judgment to each of the two defendants via U.S. Mail at the following address: B S Supermarket, d/b/a Clarimar Supermarket, 4118 3rd Avenue, Brooklyn, NY 11232.
