October 10, 2019 Opinion or Order Filing 124 CORRECTED MEMORANDUM OF DECISION AND ORDER: The Court's September 30, 2019 memorandum and order 122 is VACATED. For the reasons set forth in the attached corrected memorandum and order, Defendant Nowakowskis motion for summary judgment 110 is GRANTED, and RUMC Defendants motion for summary judgment 107 is GRANTED in part and DENIED in part. Defendant Nowakowskis motion for summary judgment is GRANTED with respect to Plaintiffs equal protection and breach of contract claims, both of which are dismissed with prejudice. RUMC Defendants motion for summary judgment is GRANTED with respect to Plaintiffs claims for disparate treatment, retaliation, violations of the Fair Labor Standards Act, and breach of contract, all of which are dismissed with prejudice. RUMC Defendants motion is DENIED with respect to Plaintiffs hostile work environment claim. The only claim remaining for trial is Plaintiffs hostile work environment claim. Ordered by Judge LaShann DeArcy Hall on 10/10/2019. VACATED pursuant to 124 Order of Judge LaShann DeArcy Hall. This entry has been modified on 10/10/2019 to indicate order 122 has been vacated. March 8, 2017 Opinion or Order Filing 68 ORDER ADOPTING REPORT AND RECOMMENDATION: The Court has reviewed the record and Magistrate Judge Bloom's Report and Recommendation 64 for clear error, and, finding none, hereby adopts the Report and Recommendation as the opinion of this Court . The State Defendants' motion to dismiss Plaintiff's Title VII claims against SUNY Downstate Medical Center and the New York State Equal Protection Claim against Dr. Nowakowski is granted and those claims are hereby dismissed. The State D efendants' motion to dismiss Plaintiff's section 1983 claim against Dr. Nowakowski is denied. Further, Plaintiff's breach of contract claim for the First ECRIP Agreement against the RUMC Defendants shall proceed in this action. (See Order for additional details). September 11, 2015 Opinion or Order Filing 42 ORDER ADOPTING REPORT AND RECOMMENDATION: For the reasons stated in the attached written Order, plaintiffs motion to amend is granted in part and denied in part. Plaintiff may not proceed with the following claims in the proposed Amended Complaint: Count II: the claim against RUMC for disparate impact under Title VII;Count V: the claim against M.D. Edward Arsura for intentional discrimination under 42 U.S.C. § 1981;Counts VIII and IX: the claims against RUMC under the New York State Human Rights Law and the New York City Human Rights Law;Count XIII: the claim for promissory estoppel; andCount XV: the claim for negligent misrepresentation.Plaintiff's motion to amend is granted in all other respects. The Court notes that on Septem ber 5, 2015, subsequent to the filing of the R&R, plaintiff filed a "First Amended Complaint for Declaratory Relief, Injunctive Relief, and Damages" ("FAC"). (Doc. No. 36.) The Court does not offer an opinion as to whether the FAC complies with this Order. By September 25, 2018, plaintiff shall either advise the Court by letter that the FAC complies with this Order, or file an amended complaint that does so. The time for service of the newly-named defendants shall begin to run on September 25, 2015.This action is re-committed to the assigned Magistrate Judge for all pre-trial purposes.
