Filing 5 MEMORANDUM AND ORDER granting 2 Motion for Leave to Proceed in forma pauperis; denying 3 Motion to Appoint Counsel and DISMISSING COMPLAINT WITH LEAVE TO AMEND: For the reasons stated in the attached Memorandum and Order, the complaint, which is being treated as filed IFP for the purpose of this Order, is dismissed for failure to state a claim. However, in light of Tekiner's pro se status, the Court directs him to file an amended complaint and an amended IFP application within thirty (30) days from the date of this Memorandum and Order. If Tekiner fails to file an amended complaint and an amended IFP application within the allotted time, judgment dismissing this action shall be entered. If timely filed, the amended complaint an d amended IFP application shall be reviewed for compliance with this Order and pursuant to 28 U.S.C. § 1915(e)(2)(B). Tekiner's application for pro bono counsel is denied without prejudice. The Clerk of Court is directed to mail a copy of this Memorandum and Order to pro se plaintiff, and to note the mailing on the docket. Ordered by Judge Roslynn R. Mauskopf on 5/30/2014.
