Filing 12 ORDER ADOPTING REPORT AND RECOMMENDATION: Pursuant to 28 U.S.C. § 636(b) and Rule 72, the Court has reviewed the R&R for clear error and, finding none, concurs with it in its entirety. See Covey v. Simonton, 481 F. Supp. 2d224, 226 (E.D.N .Y. 2007). Accordingly, the Court hereby orders that the complaint against the remaining defendants, Triad Pharmaceutical, Triad Group and H&P, is dismissed with prejudice for failure to prosecute the action. The Clerk of Court is directed to mail a copy of this Memorandum and Order to the non-appearing defendants and, in light of the stipulation of dismissal between Golden and the appearing defendants, enter the accompanying Judgment, and close the case.
