Filing 166 FINDINGS OF FACT AND CONCLUSIONS OF LAW: This Court does not find Defendant liable for any wrongdoing pursuant to N.Y. Bus. Corp. § 720. This Court concludes that Plaintiff failed to produce at trial sufficient evidence to credibly establish h is claim for breach of fiduciary duty pursuant to N.Y. Bus. Corp. § 720. In light of this finding, the Court deems 152 Defendant's Rule 52(c) motion to dismiss as moot. Finally, the Court denies 160 Plaintiff's motion to amend his pleadings pursuant to Rule 15(b) as futile. Ordered by Magistrate Judge James R. Cho on 3/29/2024. (JDP) |
