September 30, 2016 Opinion or Order Filing 43 MEMORANDUM AND ORDER: By email dated September 13, 2016, claimant in the captioned cases requests "a hearing on November 11, 2016 between 3pm and 4pm in order to address the retained counsel matter and further proceed with the case." A revi ew of the Court's docket in both cases fails to reveal an appearance by counsel in either matter, and claimant is reminded that these cases must and will proceed regardless of whether promised counsel eventually appears. The cases and Ms. Yembe& #039;s purported claims have lingered too long, and it is the Court's intention to set both matters down for hearing and final disposition before the end of the calendar year. Unfortunately, Ms. Yembe requests a conference date for November 11, 2016. Presumably, Ms. Yembe is unaware that Veterans Day, a federal holiday, falls on November 11. The conference is scheduled for November 10, 2016 at 2:00 P.M. In an effort to accommodate the claimant, the Court offers an alternate date, November 14, 2016 at 2:00 P.M. Absent a response from Ms. Yembe, and a further order of this Court, proceedings will be held on November 10, 2016 at 2:00 P.M. Ordered by Judge Raymond J. Dearie on 9/30/2016. (Rodriguez, Lori)
August 24, 2016 Opinion or Order Filing 39 MEMORANDUM AND ORDER: In a July 1, 2016 email to the Court's Case Manager, claimant Doris Yembe advised that "I am negotiating the legal fees with the attorney that will be retained for my representation, until such, I will not be reachable ." While the prospect of counsel appearing in these related forfeiture actions was welcomed by the Court, there has been no further communication from Ms. Yembe and no attorney has filed an appearance on her behalf or contacted the Court regardi ng possible representation. More concerning is Ms. Yembe's apparent belief that she may control the pace of this litigation or frustrate its timely resolution. The Court has demonstrated extraordinary patience with Ms. Yembe, but if she wishes t o press her claims against the subject properties, I once again remind her that she must be available to participate with or without counsel in accordance with the Court's schedule. May 10, 2016 Opinion or Order Filing 36 MEMORANDUM AND ORDER: By email dated April 3, 2016, claimant Doris Yembe advised the Court that she was hiring counsel in the above captioned cases, but no appearance of counsel has been filed. With respect to United States v. The Real Property and P remises Located at 2840 South Ocean Boulevard, 14-CV-2693, the government's motion to strike is denied and Ms. Yembe's motion to dismiss is denied. Ms. Yembe is directed to file an answer within 30 days of this order. With respect to United States v. Approximately 50.000 Shares of Series B Preferred Stock of Probalance, 15-CV-4371, Ms. Yembe is directed to file an answer or a Rule 12 motion within 21 days of this order. Ms. Yembe is reminded that if she intends to pursue her claim in either or both of these actions, she must participate without delay and is encouraged to promptly retain counsel torepresent her interests.
