MEMORANDUM AND ORDER, Cooper's sec. 1983 claims against the City defts of false arrest, false imprisonment, malicious prosecution, denial and delay of medical treatment, excessive detention, and all pendant state law claims against the City deft s are dismissed. The sec. 1983 claims and EMTALA claims against JHMC, Dr. Punsal, and Dr. Chan are also dismissed. The Court declines to exercise supplemental jurisdiction over Cooper's related state law claims against the hospital defts. Pltff has 10 days from its entry of his order on the docket to show cause why all claims against deft Roderik Allen should not be dismissed for failure to properly state a sec. 1983 claim against him. Cooper's remaining sec. 1983 claims of excessive f orce and failure to intercede, interposed against the individual NYPD officers, may proceed. The case is referred to Magistrate Judge Peggy Kuo for her continued pretrial supervision.
