Filing 92 ORDER ADOPTING REPORT AND RECOMMENDATIONS of Magistrate Judge James Orenstein in its entirety as the opinion of the court pursuant to 28:636(b)(1).( Ordered by Judge Allyne R. Ross on 1/4/2017) *Forwarded for jgm. (Guzzi, Roseann) |
Filing 85 OPINION AND ORDER: As set forth above, I find that plaintiffs have proven, by a preponderance of the evidence, that defendants violated the FLSA's and NYLL's overtime provisions and failed to provide wage notices and statements as requ ired under the NYLL. I award plaintiffs compensatory and liquidated damages, statutory damages, and prejudgment interest where applicable. My conclusions of fact and law, at times, differ from those proposed by the parties. Be cause my findings will necessitate different---and multiple--- damages calculations with respect to each plaintiff and cause of action, the parties should perform these calculations in the first instance. The parties are directed to file these calculations with Magistrate Judge Orenstein on or before September 30, 2016. So Ordered by Judge Allyne R. Ross on 9/16/2016. (Lee, Tiffeny) |
Filing 66 ORDER: the attached order sets forth several deadlines for additional pretrial submissions. Specifically, and as described in detail in the attached order, the parties must submit further briefing on all outstanding legal issues on or before August 29, 2016; and defendants must submit revised proposed findings of fact and conclusions of law on or before August 30, 2016. Ordered by Judge Allyne R. Ross on 8/23/2016. (Bensing, Kayla) |
