ORDER granting in part and denying in part 33 Motion for Partial Summary Judgment: For the reasons stated in the attached Memorandum & Order, Defendants' partial summary judgment motion is GRANTED in part and DENIED in part. Defendants' p artial summary judgment motion is GRANTED as to Plaintiff's claims of denial of the right to a fair trial, failure to intervene against Dieugenia, and unlawful stop and search against Pasynkov. However, Defendants' partial summary judgment motion is DENIED as to Plaintiff's (1) false arrest claim against Dieugenia, (2) unlawful stop and search claim against Dieugenia, and (3) failure to intervene claim against Pasynkov with respect to Dieugenia's alleged false arrest and unlawful search of, and use of excessive force, against Plaintiff.
