Attempting to combine these cases through removal is improper. December 4, 2015 Opinion or Order ORDER granting the plaintiff's #37 motion to compel an inspection of the defendants' restaurant. This Court finds that plaintiff has sufficiently explained why an inspection of the downstairs kitchen may yield information relevant to the claims in this action. While defendants may be correct that the plaintiff's claims are primarily based on allegations of discriminatory racial slurs being made, defendants are incorrect that discovery should be limited to whether such statements were made. The conditions under which statements were made or actions took place may be relevant to the claims and credibility of witnesses. As plaintiff explained, certain defendants recently testified that plaintiff blocked defendant Banks from exiting an area of the kitchen, an incident that preceded plaintiff's termination. Since the layout and configuration of the site in question may yield probative evidence on the accuracy of testimony regarding this event, I find that an inspection of the downstairs kitchen is warranted. See Ehrlich v. Incorporated Village of Sea Cliff, 2007 WL 1593211, at *2-*3 (E.D.N.Y. 2007). Plaintiff must identify the specific parts of the restaurant he wants to inspect and, after conferring with defendants, select a reasonable date and time for inspection that minimally intrudes on defendants' business. See Fed. R. Civ. P. 34(b)(1)(B). Defendants must be prepared to provide information on how the kitchen configuration has been changed since the relevant time period.
