June 11, 2015 Opinion or Order Filing 16 MEMORANDUM AND ORDER. Currently before the Court is the mixed 1 petition for a writ of habeas corpus filed by petitioner William Dixon on December 1, 2014. Petitioner 14 moves to hold the petition in abeyance while he exhausts his claims in st ate court. For the reasons stated herein, the motion is denied and petitioner is ordered to show cause by August 10, 2015 why this petition should not be dismissed as a mixed petition. Petitioner may elect to withdraw his unexhausted claims so th at this Court can review the properly exhausted claims. Petitioner is free to file another motion for a stay and abeyance, provided he can demonstrate "good ca use" for his failure to raise previously the claims he is now planning to exhaust in State court. Any such motion shall explain the claims to be raised in his C.P.L. 440.10 motion with sufficient particularity to enable this Court to make an independent determination that his claims are not "plainly meritless."
