MEMORANDUM AND ORDER. For the reasons set forth herein, the instant petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 is denied and the case is dismissed. A certificate of appealability shall not issue because Petitioner has n ot made a substantial showing of the denial of a constitutional right. See 28 U.S.C. § 2253(c)(2).
