For the reasons discussed in the attached Memorandum and Order, the Court grants Defendant's motion for partial summa ry judgment in part as to Plaintiff's claims for the implied covenant of good faith and fair dealing (counts two and six), except to the extent they are based on Defendant's refusal to provide technical data for the MTA bid; and grants Defe ndant's motion for partial summary judgment as to Plaintiff's claims for promissory estoppel (count seven), equitable estoppel (count eight), fraud (count nine), tortious interference with contract and with prospective economic advantage (c ounts ten and eleven), and declaratory judgment (count twelve). In addition, the Court reserves judgment on count thirteen, for breach of the Waste Oil Agreement, and instructs Plaintiff to brief the issues explained in the Memorandum and Order with in ten days of this date, with Defendant's response due ten days thereafter. Finally, the Court denies Defendant's motion for summary judgment on Plaintiff's claims for breach of the exclusivity agreement (count one) and the implied exclusivity agreement (count five), as well as Defendant's motion for summary judgment on its counterclaims for breach of contract and unjust enrichment.
