The 12 Amended Complaint fails to cure the deficiencies in the Complaint, and the action is dismissed in its entirety. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. Filing 5 MEMORANDUM & ORDER: Plaintiffs' requests to proceed in forma pauperis pursuant to 28 U.S.C. § 1915 are granted solely for the purpose of this Order. (ECF Nos. 2 , 3 .) For the reasons set forth below, the action is dism issed pursuant to 28 U.S.C. § 1915(e)(2)(B). In light of Ms. Nguyen's pro se status, the Court grants her leave to replead the Complaint to correct the deficiencies noted herein. Any amended complaint must be filed within 30 days of the date of this Memorandum and Order. The amended complaint must be captioned "Amended Complaint" and bear the same docket number as this Memorandum and Order. No summons shall issue at this time and all further proceedings shall be stayed until Ms. Nguyen has complied with this order. If Ms. Nguyen fails to file an amended complaint within 30 days, the instant action shall be dismissed. Accordingly, the Complaint is dismissed as to Thomas Nguyen for lack of stand ing and as to Tiffany Nguyen for failure to state a claim against Defendants. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
