Filing 49 OPINION & ORDER: For the foregoing reasons, defendants' motions are granted to the extent set forth herein; plaintiff's FDCPA and RESPA claims (first, second and fourth claims for relief) are dismissed in their entirety with prejudice pursu ant to Rule 12(b)(6) of the Federal Rules of Civil Procedure for failure to state a claim for a relief; and plaintiff's remaining state law claim (third claim for relief) is dismissed without prejudice pursuant to 28 U.S.C. § 1367(c).
