For the reasons set forth in the attached Memorandum and Order, Judge Go's Report and Recommendation is incorporated by reference and adopted in its entirety. Plaintiff's objections are respectfu lly denied. Accordingly, defendant's motion to dismiss plaintiff's NYLL claim and compel grievance is granted. Defendant's motion to compel arbitration and mediation is denied without prejudice. The court dismisses plaintiff's FLSA claim without prejudice because it is not ripe for adjudication.
