Filing 222 AMENDED MEMORANDUM AND ORDER: plaintiffs motion and defendants motion are granted in part and denied in part: Defendants motion for judgement as a matter of law regarding plaintiffs prima facie case of harassment is denied. Defendants motion for judg ment as a matter of law is granted with respect to mitigation, and defendant is entitled to a new trial on the issue of damages,provided that plaintiff declines remittitur of $228,204.64 from the $250,288.96 amount awarded by the jury to Fe rnandez (for an award of $22,084.32 in back pay, doubled to $44,168.64 with liquidated damages) and a remittitur of $107,392.81 from the $207,704.78 amount awarded by the jury to Roberts (for an award of $100,331.97 in back p ay, doubled to $200,663.94 with liquidated damages). Defendants motion for a new trial due to trial error is denied. Plaintiffs motion for judgment as a matter of law on the issues of front pay and reinstatement is denied. Plaintiffs motion for injunctive relief is granted in part, as specified in this order. A new trial will be ordered unless plaintiff agrees to accept remittitur no later than 30 days from the docket entry of this Order, in writing, filed electronically with the Court and served on defendants.
