ORDER: In its 112 order, the Second Circuit directed me "to consider in the first instance whether Paganas qualifies for the administrative exemption under 29 C.F.R. § 541.200." I cannot conclude at this stage that Paganas qualifies for this exemption. I therefore deny defendants summary judgment on this issue. See attached order for details. Ordered by Judge Allyne R.
