For the reasons set forth in the attached Memorandum & Order, the court explains in full its reasoning for denying Plaintiff's 149 Motion for Partial Summary judgment in its entirety; granting in part the City Defendan ts' 143 motion for summary judgment as to punitive damages against the City, the failure to train claim, and the acquiescence in the use of excessive force claim; denying in part the City Defendants' motion for summary judgment as to plai ntiff's Section 1983 and state law claims and punitive damages against Russo; and denying the Heartshare Defendants' 134 motion for summary judgment in its entirety. The parties are directed to file a joint status report regarding this c ase, as well as the related case Jewels v. Casner et al., Case No. 12-cv-1895, including an update on any settlement discussions, within thirty days of this Memorandum & Order. Ordered by Judge Kiyo A. Matsumoto on 11/12/2019.
