August 26, 2021 Opinion or Order Filing 78 ORDER ADOPTING REPORT AND RECOMMENDATION. For the reasons set forth in the attached Memorandum and Order, the Court adopts the Report and Recommendation and grants in part the parties' proposed 69 and 70 remedies. The Court approves as sati sfying due process the following: (1) within five business days of a vehicle seizure, the Port Authority Police Department must send notice of the seizure to titled owners, registered owners and lienholders via certified mail; (2) the notice should i ndicate the right to a hearing; (3) the notice should explain the hearing process; and (4) the titled owner, registered owner or lienholder is responsible for paying the towing fee when a car must be seized and towed for safekeeping after the arrest of the driver. In addition, the Court directs the parties to submit, within forty-five days of the date of this Memorandum and Order, the additional information requested in a joint submission. August 4, 2021 Opinion or Order Filing 77 REPORT AND RECOMMENDATIONS re the parties' draft proposals at 69 and 70 . For the reasons stated above, this Court respectfully recommends that the District Court grant in part the parties' proposed remedies, and requests that, within 45 days of the adoption of this report and recommendation, if it is adopted, the parties submit the additional information requested within in a joint submission. This Court thus respectfully recommends the District Court approve as satisfying due proc ess the following: (i) within five business days of a vehicle seizure, the PAPD must send notice of the seizure to titled owners, registered owners and lienholders via certified mail; (ii) the notice should indicate the right to a hearing; (iii) the notice should explain the hearing process; and (iv) the titled owner, registered owner or lienholder is responsible for paying the towing fee when a car must be seized and towed for safekeeping after the arrest of the driver. For the reasons stated herein, this Court grants in part and denies in part Plaintiff's motion for attorneys' fees and costs, and awards Plaintiff as against Defendant $190,001.00 in attorneys' fees and $548.68 in costs for a total award of $190,549.68. March 21, 2018 Opinion or Order Filing 34 ORDER ADOPTING REPORT AND RECOMMENDATION: The Court has reviewed the unopposed R&R and, finding no clear error, the Court adopts the R&R in its entirety pursuant to 28 U.S.C. § 636(b)(1). The Court grants in part and denies in part the parties&# 039; cross-motions. The Court orders Defendant to release Plaintiff's bond except as to the $80.00 towing fee, awards Plaintiff nominal damages in the amount of $1.00 against Defendant, and permits Plaintiff to move for compensatory da mages and attorneys' fees within sixty days of the date of this Memorandum and Order. The Court further directs the parties, within sixty days of this Memorandum and Order, to submit for the Court's review joint proposed revised regulations or procedures consistent with the R&R.
