ORDER granting 41 Motion to Dismiss. For the reasons set forth in the accompanying memorandum, the N.Y. Gen. Bus. Law §§ 349 and 350 claims and the common law fraud claims are dismissed with leave to replead within 30 days of the date of this order. The claim for unjust enrichment--which has been withdrawn, Pl. Opp. 14--and the claim for injunctive relief are dismissed without leave to replead. The motion to strike the class is denied. Ordered by Judge Edward R. Korman on 7/31/2017. (Park, James)
