MEMORANDUM AND ORDER granting in part and denying in part Defendant's 19 Motion to Dismiss for Failure to State a Claim: For the reasons stated in the attached memorandum and order, the Court grants in part and denies in part American's motion to dismiss. Plaintiff's claims under 42 U.S.C. § 2000a, 42 U.S.C. § 2000d, and 49 U.S.C. § 40127(a) are dismissed. Plaintiff's claims under 42 U.S.C. § 1981 and N.Y.S.
