Filing 29 ORDER ADOPTING REPORT AND RECOMMENDATIONS. For the reasons set forth in the attached order, the court adopts the recommendations in Judge Bloom's thorough and well-reasoned report and recommendation with one minor modification. The case will p roceed to discovery under Judge Bloom's supervision only on plaintiff's claims against Delta alleging that it failed to accommodate plaintiff's request for a desk and chair and retaliated against her in violation of the ADA, the Rehabi litation Act, and the NYSHRL. Plaintiff's federal claims against defendant Anderson, Title VII claims, reasonable accommodation claim pertaining to her request to transfer to a flight attendant position, hostile work environment claim, claims u nder 42 U.S.C. §§ 1981 and 1983, claims under the Federal Tort Claims Act, and state law tort claims are dismissed with prejudice. Plaintiff's NYSHRL claim against Anderson is also dismissed, and the court declines to specify that thi s dismissal is without prejudice. Plaintiff is denied leave to file an amended complaint. The Clerk of Court is respectfully requested to serve a copy of this order on plaintiff at her address of record and to note service on the docket. Ordered by Judge Kiyo A. Matsumoto on 3/29/2018.
