MEMORANDUM & ORDER: Plaintiff's 2 request to proceed in forma pauperis is granted. The Complaint is dismissed and Plaintiff is granted leave to amend the Complaint within 30 days of the date of this Memorandum and Order. If Plaintif f fails to file an amended complaint within 30 days of this Memorandum and Order, the Court will dismiss this action. No summons shall issue at this time and all further proceedings shall be stayed for 30 days. The Court certifies pursuant to 28 U .S.C. § 1915(a)(3) that any appeal would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of any appeal.
