MEMORANDUM AND ORDER: The complaint seeking damages is dismissed, without prejudice, for lack of subject matter jurisdiction. Fed. R. Civ. P. 12(h)(3). The plaintiff's complaint seeking injunctive relief in the state court action pending under Index No. 506696/2015 is dismissed under the Younger Abstention doctrine and the Anti-Injunction Act. In light of the plaintiff's pro se status, the Court grants the plaintiff leave to file an amended complaint within 30 days from the entry of this Memorandum and Order. Ordered by Judge Ann M.
