June 16, 2021 Opinion or Order Filing 12 ORDER: Naquan Glover ("Petitioner"), proceeding pro se, filed this petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 ("the Petition"), challenging his conviction for Manslaughter in the First-Deg ree and two counts of Criminal Possession of a Weapon in the Second Degree. Petitioner raised three grounds for relief: (1) that the State Courts erroneously upheld the prosecutors reverse-Batson challenge to a preemptory strike against a jur or; (2) ineffective assistance of trial counsel; and (3) Petitioner's 22-year sentence was excessive. By Decision and Order dated April 20, 2020, the Petition was denied on the merits. By letter dated May 12, 2020, Petitioner requests that the Court review its decision denying the habeas petition. ECF No. 11 . The Court liberally construes Petitioner's request as a motion pursuant to Federal Rule of Civil Procedure 60(b). Petitioner's motion for relief pursuant to Rule 60(b) a ccordingly is DENIED as lacking in merit. A certificate of appealability will not issue as the motion fails to raise any substantial issues. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in go od faith and therefore in forma pauperis status is denied for purpose of an appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of the Court is directed to close the case. So Ordered by Judge William F. Kuntz, II on 6/16/2021. (Love, Alexis)
