Filing 5 ORDER granting 2 Motion for Leave to Proceed in forma pauperis. Plaintiffs request to proceed in forma pauperis pursuant to 28 U.S.C. § 1915 is granted solely for purposes of this Order. The Complaint is dismissed with prejudic e. Plaintiff has failed to allege that she has standing to bring the claims she asserts, and the claims appear to be untimely. The Court has considered whether to allow Plaintiff to amend her Complaint in order to assert standing and grounds for eq uitable tolling. However, the claims must be dismissed pursuant to 28 U.S.C. § 1915(e)(2)(B) in any case, so amendment would be futile. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good fait h and therefore in forma pauperis status is denied for purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court shall enter judgment and close this case. Ordered by Judge Pamela K. Chen on 8/25/2017. (Fletcher, Camille) |
