June 19, 2018	Filing 20 MEMORANDUM & ORDER: Currently before the Court is Defendant's 10 motion to dismiss the Complaint for lack of subject matter jurisdiction and failure to state a claim pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure. The Court grants Defendant's 10 motion and dismisses the Complaint. For the reasons discussed herein, the Court dismisses the Complaint without prejudice for lack of subject matter jurisdiction and for failure to state a claim pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure, respectively. The Court grants Plaintiff 30 days from the date of this Memorandum and Order to amend the Complaint. No summons shall issue at this time, and al l further proceedings shall be stayed for 30 days. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
