Filing 71 MEMORANDUM AND ORDER: For the reasons stated in the attached Memorandum and Order, the motion on the pleadings 53 is granted, the RICO claim is dismissed with prejudice, and the Court declines to exercise supplemental jurisdiction over the remaining state law claims, and those are therefore dismissed without prejudice. Filing 45 ORDER: For the reasons stated in the attached opinion, the motion for leave to file a Third Amended Complaint 41 is granted; the motion to file a Second Amended Complaint 37 is moot; and the motion for a judgment on the pleadings 23 is denied. Plaintiff shall file the Third Amended Complaint via ECF by March 23, 2018. Plaintiff is not permitted to file any further amendments or motions to amend. Defendants may file a motion to dismiss the Third Amended Complaint by April 23, 20 18. Any response is due 30 days after filing; and a reply is due two weeks after a response.
