Filing 50 ORDER: For the reasons stated in the attached Memorandum & Order, Defendants' motion for summary judgment is granted in part and denied in part. Only Plaintiff's fair trial claim against Defendant Loria will proceed to trial. Because there is no claim surviving against Defendants City of New York and Maresca, they are terminated as parties to this action. The parties shall file a joint pre-trial order that complies with the Court's Individual Rules within thirty (30) days of the date of this Memorandum & Order. Ordered by Judge Pamela K.
