August 18, 2020 MINUTE ENTRY: Oral argument on defendants' #35 Motion for Summary Judgment was held by telephone before Judge Margo K. Brodie on August 18, 2020. Jessica Lynn Kronrad appeared on behalf of plaintiff. Rachel Seligman Weiss appeared on behalf of defendants. The Court heard argument from the parties on the motion for summary judgment. For the reasons set forth on the record, the Court granted the motion as to (1) the federal false arrest claim against Detective Shawn Solar; and denied the motion as to (2) the federal false arrest claim against Sergeant Elyse Martinez; (3) the excessive force claims against both individual defendants; (4) the state law false arrest claim against the City of New York (the "City"); (5) the state law assault and battery claim against the City; and (6) the respondeat superior claim against the City. The Court found that there were triable issues of fact as to whether Sergeant Martinez had probable cause to arrest plaintiff. The Court further found that plaintiff's testimony, while it has changed over time, is not so contradictory as to warrant its exclusion and non-consideration by the Court. Viewing the facts in the light most favorable to the non-movant, the Court found that there were triable issues of fact as to plaintiff's excessive force claims based on her interactions with Detective Solar when he entered the home, the manner in which she was handcuffed, and her other interactions with Sergeant Martinez. The Court found that plaintiff's assault and battery claim survives summary judgment for the same reasons as her excessive force claims, and that the respondeat superior claim survives along with plaintiff's state law claims. In the event that the parties are unable to settle the case, the Court directed the parties to submit a proposed joint pretrial order.
