ORDER granting 22 Motion to Dismiss for Failure to State a Claim -- For the reasons set forth in the ATTACHED WRITTEN OPINION AND ORDER, Defendants' motion to dismiss the Amended Complaint as to the Individual Defendants for lack of personal jurisdiction pursuant to Fed. R. Civ. P. 12(b)(2) is denied. As to the non-appearing defendant, Winterkorn, this action is dismissed as to him for lack of personal jurisdiction. Defendants' motion to dismiss on forum non conveniens grou nds is denied. Defendants' motion to dismiss the Amended Complaint pursuant to Fed. R. Civ. P. 12(b)(6) is granted and this action is dismissed in its entirety with prejudice. The Clerk of the Court is directed to close this case. SO ORDERED by Judge Dora Lizette Irizarry on 5/20/2021.
