Filing 13 MEMORANDUM AND ORDER, For the above-stated reasons, plaintiff's amendedcomplaint is dismissed pursuant to 28 U.S.C. § 1915A(b) and 28 U.S.C. § 1915 (e) (2) (B) (ii). His request for a refund of the filing fee is denied. The Court certi fies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The C lerk of Court is respectfully directed to enter judgment dismissing this action, to serve a copy of this Memorandum and Order, the judgment, and an appeals packet on plaintiff at his address of record, and to close this case.
