Filing 8 JUDGMENT in favor of C-Cubed Group, Inc., Anthony Chan against Lemi Miserbiev. That this action is dismissed without prejudice; and that this case is closed. (Ordered by Jalitza Poveda, Deputy Clerk on 5/10/2018) c/m (Galeano, Sonia) |
ORDER ADOPTING REPORT AND RECOMMENDATION. With notice given, no party has filed objections to the #7 report and recommendation in which Magistrate Judge Lois Bloom concluded that plaintiff's action should be dismissed without prejudice pursuant to Rule 4(m) of the Federal Rules of Civil Procedure. In accordance with the applicable clear-error standard of review, see Dafeng Hengwei Textile Co. v. Aceco Indus. & Commercial Corp., 54 F. Supp. 3d 279, 283 (E.D.N.Y. 2014), the Court carefully reviewed Magistrate Judge Bloom's report and recommendation, and found it to be correct, well-reasoned, and free of any clear error. The Court, therefore, adopts it in its entirety as the opinion of the Court. Accordingly, the plaintiff's action is dismissed without prejudice, and the Clerk of Court is respectfully directed to close this case for administrative purposes. Ordered by Judge Eric N. Vitaliano on 5/9/2018. (Fernandez, Ashley) |
Filing 7 SUA SPONTE REPORT AND RECOMMENDATION: Under Rule 4(m), plaintiff was required to serve defendants with the complaint and summons by 1/30/2018. As of the date of this Report, the Court's record does not reflect that plaintiff has served defendants. Because plaintiff has failed to file proof of service or show good cause why service was not timely effected on defendants, it is respectfully recommended that plaintiff's #1 action should be dismissed without prejudice pursuant to Rule 4(m) of the Federal Rules of Civil Procedure. Pursuant to 28 U.S.C. 636(b)(1) and Rule 72(b)(2) of the Federal Rules of Civil Procedure, the parties shall have 14 days from service of this Report to file written objections. SO ORDERED by Magistrate Judge Lois Bloom, on 4/19/2018. C/mailed. (Objections to R&R due by 5/3/2018.) (Latka-Mucha, Wieslawa) |
Filing 6 ORDER: Under Rule 4(m), plaintiff was required to serve defendants with the complaint and summons by 1/30/2018. To date, plaintiff has failed to file proof of service on the docket. If proof of service is not filed with the Court by 3/28/2018, or if plaintiff fails to show good cause why such service was not effected by 1/30/2018, the Court shall dismiss this action without prejudice. SO ORDERED by Magistrate Judge Lois Bloom, on 3/12/2018. (Attachments: #1 Individual Practices of Magistrate Judge Lois Bloom.) Service upon Defendants due by 3/28/2018. (Latka-Mucha, Wieslawa) |
