Kuntz, II, in Room 6H North, located at 225 Cadman Plaza East, on Thursday, August 2, 2018 at 10:30 A.M., why an Order should not be made, pursuant to Rule 65 of the Federal Rules of Civil Procedure, enjoining the Defendant during the pendency of this action from using the BIOPLUS mark, the term Bio Plus, or any other designation or mark likely to cause confusion with the BIOPLUS Mark in their listing with the National Council for Prescription Drug Program, Caremark, SureScripts, and anywhere else in commerce; and from using any advertisements using the trademark or trade name BIOPLUS or any designations or marks likely to cause confusion with the BIOPLUS Mark.
