ORDER TO SHOW CAUSE: Defendant is directed to show cause why removal is permitted in this case in light of the fact that Defendant is a resident of New York. 28 U.S.C. 1441(b)(2) prohibits a defendant who is a citizen of the state in which the action is brought from removing the case to federal court if the basis for the Courts jurisdiction is diversity of citizenship. See Mallek v. Allstate Indem. Co., No. 17-CV-5949, 2018 WL 3635060, at *8-9 (E.D.N.Y. Mar. 12, 2018), report and recommendation adopted, 2018 WL 3629596 (July 31, 2018). Here, the original action was brought in Civil Court in New York State and Defendant is a citizen of New York. The only alleged claims, as far as the Court can discern, are state law claims. As a result, Defendant may not remove the case to federal court. Defendant is ordered to show cause, that is to explain, why this case may proceed in federal court, and do so by 9/7/2018.
