Filing 4 ORDER: Plaintiff's #2 request to proceed in forma pauperis under 28 U.S.C. 1915 is granted. Accordingly, plaintiff's 42 U.S.C. 1983 claims against defendants NYPD, DeBlasio, O'Neill, and Fucito are dismissed for failure to state a claim on which relief may be granted. No summons shall issue as to these defendants. The Clerk of Court is directed to amend the caption to reflect the dismissal of these parties from this action. Plaintiff's complaint against New York City, NYPD Detective Bennett of the 77th Precinct, and Deputy Sheriff Williams may proceed. The Clerk of the Court is directed to issue a summons against these three defendants; the United States Marshals Service shall serve the complaint and this order on these defendants without prepayment of fees. A copy of this order shall be served on the Special Federal Litigation Division of the Corporation Counsel. The case is referred to the Honorable Robert M. Levy, United States Magistrate Judge, for pretrial supervision. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
