Filing 6 Minute Entry: Initial Conference Hearing held on 11/14/2018 before Magistrate Judge Steven M. Gold. Cassar for plaintiff, Walsh for defendant. (1) By November 28, defendant will either withdraw or seek leave to move with respect to its affirmative defenses based on service, jurisdiction, and venue. (2) Interrogatories and document demands will be served by November 29, 2018. Any site inspection will be conducted by February 1, 2019. Parties and fact witnesses will be deposed by March 15. Plaintiff will serve her expert reports by March 15, 2019, and defendant will conduct any required medical evaluation and serve its expert reports by April 19, 2019. THE COURT WILL HOLD A FURTHER CONFERENCE AT 3:00 PM ON MAY 9, 2019. The parties shall be prepared (1) to state their respective positions on settlement, with PRINCIPALS WITH FULL SETTLEMENT DECISION-MAKING AUTHORITY (UP TO THE AMOUNT LAST DEMANDED FOR DEFENDANTS, DOWN TO THE AMOUNT LAST OFFERED FOR PLAINTIFFS) PRESENT OR AVAILABLE BY TELEPHONE THROUGHOUT THE CONFERENCE, (2) to schedule any anticipated depositions of experts, (3) to articulate the basis for any anticipated summary judgment motions and to be familiar with any premotion conference procedures required by the district judge presiding over the case, and (4) to state whether they will agree to assignment of this case to a magistrate judge for all purposes, including jury trial and entry of final judgment. Unless they advise the Court beforehand that the parties are not interested in attempting to negotiate a settlement or that they prefer to do so in another forum, counsel shall submit mediation statements by May 3, 2019. The mediation statements may be submitted ex parte by email addressed to gold_chambers@nyed.uscourts.gov (note that there is an underlined space between gold and chambers).
