November 27, 2018 Opinion or Order ORDER re #10 Joint Letter. This is not a joint letter. Defendants' portion of the letter says nothing. Defendants apparently believe that they don't have to do anything until their answer, despite the Court's Order for a joint summary letter. But as any lawyer with any experience knows, "[i]n truth, the answer in a civil action is the most useless paper in the courthouse." Alexander By and Through Alexander v. Richardson-Merrell Inc., 541 F.Supp. 93, 94 (S.D.N.Y. 1982). Defense counsel has been in this case for a month, which is plenty of time to determine if defendants have any viable defense. The conference is adjourned to 12/3/18 at 5:15 p.m. so that defendants can submit a supplemental letter by 11/30/18 advising how they intend to defend this case. If they do not, the Court will enter an Order under Fed. R. Civ. P. 16(f) confirming that there is no defense. Ordered by Judge Brian M. Cogan on 11/27/2018.
