Minute Entry and Order for Initial Status Conference held before Judge Brian M. Cogan on 1/10/2019. Counsel for both parties present. The Court held brief oral argument on its 11/16/2018 order to show cause. Defendant to file its motion for summary judgment by 1/31/2019. Plaintiff may either file a cross-motion for summary judgment on that same day, or file an opposition to defendant's motion by 2/21/2019. If plaintiff files a cross-motion, then both parties' oppositions are due on 2/28/2019, and the parties need not file replies. If plaintiff chooses to oppose defendant's motion rather than cross-move, then defendant's reply in support of its motion is due on 2/28/2019. ORDER. Plaintiff's counsel has circumvented this Court's mandatory arbitration procedure by including a superficial request for unspecified injunctive relief in the complaint. However, although the Second Circuit has not resolved the issue, it has noted that the great weight of authority recognizes that there is no right to injunctive relief under the FDCPA. See Hecht v. United Collection Bureau, Inc,, 691 F.3d 218, 223 n.1 (2d Cir. 2012). Plaintiff is therefore ORDERED TO SHOW CAUSE by 11/26/2018 why an Order should not be entered: (1) referring this case to mandatory arbitration pursuant to the local rules of this Court; and (2) directing plaintiff's counsel to certify future cases he brings under the FDCPA as eligible for mandatory arbitration.
