Filing 3 MEMORANDUM AND ORDER denying, without prejudice, 1 Motion to Compel. Plaintiff's motion to modify the Scheduling Order should be refiled in the Western District of Texas and addressed to the judge who issued that order. Plaintiff's mot ion to enforce compliance is denied, without prejudice, as the Lisa Subpoena is untimely. In the event plaintiff secures an extension of the discovery schedule from the Western District of Texas, any renewed motion to enforce the Lisa Subpoena, or a ny subsequent subpoena served on Thomas Lisa, should be filed in the EDNY's Central Islip courthouse, as the subpoena calls for compliance in Mineloa, New York, which is in Nassau County. See attached. Ordered by Chief Mag. Judge Roanne L. Mann on 6/25/2018. (Proujansky, Josh) |
