January 29, 2019 Opinion or Order Filing 5 MEMORANDUM AND ORDER. Plaintiff's #2 Motion for Leave to Proceed in forma pauperis is granted. The plaintiffs claims against John Doe #2 are dismissed. No summons shall issue to this defendant and the Clerk of Court is respectfully directed to amend the caption to reflect the dismissal of this defendant. See 28 U.S.C. 1915A(b); 1915(e)(2)(B). The plaintiffs claims against Detective John Doe #1, Shield No. 947508 of the 105th Precinct, and correction officers John Doe #3 and John Doe #4 will proceed. Because the true identities of these defendants are unknown at this time, the Court requests that the CorporationCounsel of the City of New York identify the full names of these John Doe defendants, who were allegedly involved in the arrest that occurred on October 27, 2016, at the 105th Precinct and the incident that occurred on November 17, 2016, at the Queens County Supreme Court. The Corporation Counsel isdirected to provide the addresses where the defendants can be served, but does not have to defend or indemnify them at this time. This order merely provides a means by which plaintiff may name and properly serve the defendants as instructed by the Second Circuit in Valentin. The Corporation Counsel is to produce the identifying information to the plaintiff within 45 daysof the entry of this order. Once this information is provided, the plaintiffs complaint will be deemed amended to reflect the full names of all defendants and the Court will direct service on all remaining defendants accordingly. The Clerk of Court is respectfully directed to send a copy of this order and the plaintiff's complaint to the Corporation Counsel of the City of New York and to the plaintiff No summons will issue at this time. The case is referred to Magistrate Judge Lois Bloom for pretrial supervision. Ordered by Judge Ann M. Donnelly on 1/28/2019. (Greene, Donna)
