Filing 9 MEMORANDUM AND ORDER: For the reasons set forth in the attached memorandum and order, Plaintiff's request #1 to proceed in forma pauperis pursuant to 28 U.S.C. 1915 is GRANTED, and the complaint is DISMISSED pursuant to 28 U.S.C. 1915(e)(2)(B) and 1915A. Plaintiff is granted leave to file an amended complaint within 30 days from the entry of this memorandum and order. Cruz v. Gomez, 202 F.3d 593 (2d Cir. 2000). The amended complaint must be captioned as an "Amended Complaint" and bear the same docket number as this order. Failure to file an amended complaint with 30 days, as directed by this memorandum and order, will result in Plaintiffs case being dismissed for failure to prosecute. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully directed to mail a copy of this order to the pro se litigant.
