An airline passenger "assumes the risk" that when they use the lavatory on an airplane, there will be liquid on the floor which causes them to fall? If the Court wanted boilerplate affirmative defenses, it wouldn't have asked for a joint letter. No doubt, defendant did an accident investigation and there is a report. It is ORDERED to file a supplemental letter prior to the conference explaining its version of what happened here, in the absence of which the Court may enter an Order pursuant to Rule 16(f) finding that defendant has no viable defenses to liability.
