IT IS HEREBY STIPULATED, CONSENTED ANDAGREED TO, by and between Plaintiffs and Defendants, that: Plaintiffs hereby withdraw, without prejudice, its "Motion to Compel" (ECF No. #2 ) seeking to stay, temporarily restrain and enjoin Defendants from disqualifying Plaintiffs from the Program for a period of six months; and Defendants agree that they will stay, during the pendency of this litigation, the March 20, 2019 "Final Agency Decision" disqualifying Plaintiffs from the Program for a period of six months. Such stay will be in effect until the earlier of either the conclusion of this litigation or subsequent order of this Court lifting this stay. Nothing in this Stipulation and Order shall in any manner or to any degree be construed to be a concession of liability (or a concession that the six-month disqualification of Plaintiffs was improper or unlawful in any way), and shall not prejudice Defendants' right to oppose the relief Plaintiffs are seeking in their Complaint.
